Terms of service

These Terms of Service govern your access to and use of the Goose Funding website and the services offered through it. By visiting the site, submitting a request, or otherwise using our services, you agree to these terms. If you do not agree, please do not use the site.

Goose Funding, LLC ("Goose Funding", "we", "us") is a direct private funder that provides business funding products to companies in the United States. References to "you" mean the business and the individual submitting information on its behalf.

We arrange and provide business funding products, including purchase order financing, equipment finance, merchant cash advances, business working capital, business cash advances and invoice factoring. Product availability, eligibility and structure vary by applicant, industry and state.

Our site is for business purposes only. It is not intended for personal, family or household use, and we do not provide consumer loans.

Nothing on this site is an offer or commitment to lend. Submitting a request does not guarantee approval, a specific amount, a specific rate or a specific term. Any funding is subject to our review, underwriting and approval, and to the terms of a separate written agreement you sign.

Quotes and estimates are indicative only and may change after we review your documents, bank activity or business profile.

You must be at least 18 years old, authorized to act on behalf of the business you submit information for, and located in the United States. You agree that all information you provide is accurate, complete and current, and that you will update it if it changes.

To evaluate a request we ask for information about you and your business, which may include your name, contact details, business name, funding amount, revenue and supporting documents. Our collection and use of that information is described in our Privacy Policy.

You authorize us to verify the information you provide, including through business and personal credit information where applicable, as described in the authorization you sign as part of the application.

Rates, fees and repayment structures depend on the product and your business profile. All costs are disclosed in your funding agreement before you sign. Payment schedules may be daily, weekly or structured to the product.

Merchant cash advances and business cash advances are purchased receivables, not loans, and are repaid through a specified percentage of future sales. Invoice factoring involves selling unpaid invoices at a discount. Review your agreement carefully before signing.

• Provide accurate, complete and current information.
• Do not submit information for a business you are not authorized to represent.
• Do not use the site for unlawful purposes or attempt to interfere with its operation.
• Keep any account or application credentials confidential.

When you submit a request, we and our service providers may contact you by phone, voicemail and email about your request, your application, your funding and related products at the contact details you provide. We send text messages only if you tick the SMS consent box on the form, or if you agreed to text messages in the funding agreement you signed with us. You can ask us to stop contacting you by email at any time, and you can opt out of text messages as described below.

This section applies to text messages you receive from Goose Funding. It is the program terms required by mobile carriers and is part of these Terms of Service.

Program description

Goose Funding sends SMS messages about business funding requests. Messages may include a confirmation that your request was received, questions or requests for documents while your file is in underwriting, status updates on your application, offers or quotes and next steps, and reminders about an open request. We do not send promotional text messages to people who have not opted in. If you have a funding agreement with us, we also send account and payment notifications, such as payment confirmations, returned or missed payment notices, balance updates and payment reminders.

How you opt in

You opt in when you submit a request form on this site and check the consent box agreeing to be contacted by SMS, email and phone. That checkbox is never pre-selected. By opting in you confirm that the mobile number you provided belongs to you or that you are authorized to consent on behalf of the business for that number. Clients with a funding agreement also agree to receive text messages about their account when they sign their agreement with Goose Funding.

Consent is not a condition

Agreeing to receive text messages is not a condition of obtaining funding or of any purchase. If you prefer not to be contacted by text, contact us by phone or email instead and we will handle your request without texting you.

Message frequency and cost

Message frequency varies based on your request and where it sits in the process. Message and data rates may apply depending on your mobile plan. Goose Funding does not charge you for text messages; your carrier's standard messaging rates apply.

How to opt out or get help

Reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT to any message to stop receiving texts from us. You will receive one confirmation message and then no further text messages. Reply HELP for help, or contact us through the contact page. Opting out of texts does not affect our ability to contact you by phone or email, and it does not cancel an application or a funding agreement.

Your mobile information

We do not sell, rent or share your mobile phone number, your SMS opt-in or your text message content with third parties or affiliates for their own marketing or promotional purposes. We use mobile information only to communicate with you about your request and to operate the messaging program, as described in our Privacy Policy.

Carriers and delivery

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed. Supported carriers may change, and not all mobile devices or plans are compatible with the messaging program.

Age and number changes

By opting in you confirm you are at least 18 years old. If you change or deactivate your mobile number, you agree to reply STOP before doing so and to tell us about the change so we do not text a number that no longer belongs to you.

Changes to the messaging program

We may change or end the messaging program at any time. If we make a material change to these SMS terms we will update this page and, where required, ask you to opt in again.

You may not use this site to submit false information, impersonate another person or business, upload malicious code, scrape content at scale, or interfere with the security or availability of the site. We may refuse service, restrict access or cancel a request if we believe these terms have been violated.

The site, including its text, design, graphics, logos and software, is owned by Goose Funding or its licensors and is protected by intellectual property laws. You may view and print pages for your own business use. You may not copy, republish or redistribute the content without our written permission.

The site may link to third-party websites or rely on third-party services, such as banking, identity verification and communication providers. We do not control those third parties and are not responsible for their content, availability or practices. Their terms and privacy policies apply to your use of them.

The site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or that any information on it is complete or current. Information on the site is general in nature and is not financial, legal or tax advice.

To the maximum extent permitted by law, Goose Funding and its officers, employees and agents will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue, arising out of or relating to your use of the site. Our total liability for any claim relating to the site will not exceed one hundred US dollars.

You agree to indemnify and hold Goose Funding harmless from claims, losses, liabilities and expenses, including reasonable legal fees, arising out of your breach of these terms, your misuse of the site, or information you submit that is inaccurate or that you were not authorized to provide.

These terms are governed by the laws of the state in which Goose Funding, LLC is organized, without regard to conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in that state, and you consent to their jurisdiction. Nothing in these terms limits any right you may have under applicable consumer protection law.

We may update these terms from time to time. The revised version will be posted on this page with a new "last updated" date, and material changes will apply going forward. Your continued use of the site after an update means you accept the revised terms.
